{"id":47339,"date":"2026-09-14T11:58:28","date_gmt":"2026-09-14T10:58:28","guid":{"rendered":"https:\/\/chopsybaby.com\/magazine\/?p=47339"},"modified":"2026-09-14T12:57:12","modified_gmt":"2026-09-14T11:57:12","slug":"send-parent-blame-rises-again-from-bristols-education-director","status":"publish","type":"post","link":"https:\/\/chopsybaby.com\/magazine\/send-parent-blame-rises-again-from-bristols-education-director\/","title":{"rendered":"SEND Parent Blame Rises Again From Bristol&#8217;s Education Director"},"content":{"rendered":"\n<h6 class=\"wp-block-heading\">&#8211; Parent blaming comments were made in Children and Young People Policy Committee last week<br>&#8211; 14 Children and young people have been waiting over 70 weeks for an EHCP<\/h6>\n\n\n\n<p class=\"wp-block-paragraph\">Fictitious Bristol families with children and young people with special educational needs and disabilities ( Send), are being blamed for causing delays to the Education Health Care Plan (EHCP) process by not bothering to turn up to appointments.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The comments were made by the city&#8217;s Director of Education and Skills in a meeting at the council house last week.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Long-term committee member Councillor Susan Kollar was unaware of what an EHCP exception case was, despite scrutinising EHCP data for some years.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">She said: &#8220;At the bottom of the first bit of table on page 23 it says in May 2026 there were 15 exception cases. I just wanted to clarify what that actually means?&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Executive Director of the Children and Education Directorate, Hannah Woodhouse said: &#8220;So this is a national measure. It relates to the percentage of EHCPs issued within 20 weeks. There is a national expectation that there is a group of exception cases. I don&#8217;t know if Vik wants to talk a little bit to that?&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Director of Education and Skills at Bristol City Council, Vik Verma said: &#8220;Exceptions are defined in statutory guidance and it could be, to take one example, if a family has missed multiple appointments with, say, an educational psychologist, that&#8217;s allowed for as an exception and therefore wouldn&#8217;t be counted in against the twenty week timeliness figures. <\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;Obviously the reverse wouldn&#8217;t be true. So if it was the educational psychologist missing an appointment or canceling an appointment, that wouldn&#8217;t be counted. That&#8217;s not an exception. But if you know, if a parent missed various appointments, that could be considered an exception and that&#8217;s allowable in reporting the data.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">&#8220;They tend to be very small numbers that we would record in that space. So I think in this case it&#8217;s about 15.&#8221;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Far from being a &#8220;national expectation&#8221; as described Woodhouse, the timing of issuing a finalised EHCP is to be found in the The Special Educational Needs and Disability Regulations 2014.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">This says that a local authority must send the finalised EHCP to the children&#8217;s parents or young person, the governing body, proprietor or principal of any school, other institution or provider of relevant early years education named in the EHCP and to the responsible commissioning body.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">And, this must be done &#8216;as soon as practicable, and in any event within 20 weeks of the local authority receiving a request for an EHC needs assessment in accordance with section 36(1) of the Act, or of the local authority becoming responsible for the child in accordance with section 24 of the Act.&#8217;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">There are very specific incidents when the time limit does not have to be complied with. These are &#8216;exception cases&#8217; and set out in Regulation 10(4)(a) to (d) and 13(3):<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(a)<\/strong> the authority has requested advice from the head teacher or principal of a school or post-16 institution during a period beginning one week before any date on which that school or institution was closed for a continuous period of not less than 4 weeks from that date and ending one week before the date on which it re-opens;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(b)<\/strong> the authority has requested advice from the person identified as having responsibility for special educational needs (if any) in relation to, or other person responsible for, a child\u2019s education at a provider of relevant early years education during a period beginning one week before any date on which that provider was closed for a continuous period of not less than 4 weeks from that date and ending one week before the date on which it re-opens;<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(c)<\/strong> exceptional personal circumstances affect the child or the child\u2019s parent, or the young person during that time period ; or<\/p>\n\n\n\n<p class=\"wp-block-paragraph\"><strong>(d) <\/strong>the child or the child\u2019s parent, or the young person, are absent from the area of the authority for a continuous period of not less than 4 weeks during that time period.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">None of these mention parents failing to keep appointments despite Bristol City Council officers illuding to this when replying to the committee&#8217;s councillors.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">The timeliness of EHCPs is still keeping children and young people waiting an unlawful amount of time.<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Whilst the council says the current backlog will be cleared by the end of 2026, it will be little comfort to the families who are waiting past the 20 weeks, with some now well past 70 weeks.<\/p>\n\n\n\n<figure class=\"wp-block-image aligncenter size-full\"><a href=\"https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/EHCP-timeliness-Bristol-2026.jpg\"><img loading=\"lazy\" decoding=\"async\" width=\"916\" height=\"515\" src=\"https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/EHCP-timeliness-Bristol-2026.jpg\" alt=\"\" class=\"wp-image-47343\" srcset=\"https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/EHCP-timeliness-Bristol-2026.jpg 916w, https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/EHCP-timeliness-Bristol-2026-300x169.jpg 300w, https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/EHCP-timeliness-Bristol-2026-768x432.jpg 768w\" sizes=\"auto, (max-width: 916px) 100vw, 916px\" \/><\/a><\/figure>\n\n\n\n<figure class=\"wp-block-image size-full\"><img loading=\"lazy\" decoding=\"async\" width=\"970\" height=\"236\" src=\"https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/Educational-Psychologists-Delay-Bristol.jpg\" alt=\"\" class=\"wp-image-47346\" srcset=\"https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/Educational-Psychologists-Delay-Bristol.jpg 970w, https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/Educational-Psychologists-Delay-Bristol-300x73.jpg 300w, https:\/\/chopsybaby.com\/magazine\/wp-content\/uploads\/Educational-Psychologists-Delay-Bristol-768x187.jpg 768w\" sizes=\"auto, (max-width: 970px) 100vw, 970px\" \/><\/figure>\n\n\n\n<p class=\"wp-block-paragraph\"><\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Educational psychology (EP) delays have been so bad that output has &#8216;improved&#8217; by 22 per cent from 2025.
