Mediation for separating couples comes into force

The new Family Procedure Rules 2010 come into force today, meaning that separating couples will have to talk about child access outside of court.

The mediation rule affects the way cases will progress through the family courts.

Coming into force on 06 April 2011, it is aiming to let people make their own decisions about matters involving their children.

Separated couples will have to attend a Mediation Information and Assessment meeting to find out whether mediation can happen.

If the mediation does not happen, the court will need to know why, though an emergency situation, refusal to attend or any history of domestic violence will be taken into consideration.

Specially trained mediators must be used – which will cost to those not entitled to funding.
